Most pet owners in Spain assume the same thing: “My dog would never do that.” And then one day, it does. Maybe it snaps at a child in the park. Maybe it bolts through a neighbour’s fence and causes an accident. Maybe it simply scratches someone who needed stitches.

Here’s what nobody tells you until it’s too late: under Spanish law, you are fully liable for any damage your pet causes — whether you were negligent or not. Article 1905 of the Spanish Civil Code is unambiguous on this point. If your animal causes harm, the bill is yours.

And that bill can be enormous.

Spanish law holds you personally responsible

Article 1905 states that the owner of an animal — or whoever uses it — is liable for any damage it causes, even if the animal escapes or strays. The only exceptions are force majeure or if the victim themselves provoked the incident. In practice, those exceptions rarely apply.

This isn’t theoretical. Spanish courts regularly award compensation for dog bites, property damage caused by animals, and even road accidents triggered by a pet escaping. You don’t need to have done anything wrong. You just need to be the owner.

Real scenarios that could cost you thousands

A dog bite at the park

This is the most common claim. A bite that requires stitches, a hospital visit and follow-up treatment can easily generate medical costs of €3,000 to €15,000 or more. If the victim suffers lasting psychological effects — which courts take seriously — the compensation can go much higher.

Damage to someone’s property

Your dog digs up a neighbour’s garden. Your cat scratches a visitor’s car. Your pet knocks over something expensive in someone else’s home. Every one of these situations can result in a formal claim against you personally.

A traffic accident

If your pet escapes and causes a driver to swerve, you could be liable for vehicle damage, injuries to passengers and even damage to road infrastructure. These claims can run into tens of thousands of euros.

Incidents in communal spaces

If you live in an apartment building or urbanisation and your pet regularly damages shared areas or communal property, the residents’ association can take legal action against you.

It’s not just about money — there are legal consequences too

A serious incident involving your pet doesn’t just cost money. In Spain, depending on the severity, you could face:

  • A formal police report (denuncia)
  • Confiscation of your animal while the case is investigated
  • A court order preventing you from owning pets in the future
  • Criminal liability if gross negligence is established

Without legal cover in place, you’re also paying for a lawyer out of pocket.

Since 2023, third-party liability pet insurance is mandatory in Spain

Spain’s Animal Welfare Law (Ley 7/2023) introduced a legal requirement for all dog owners to have third-party liability insurance in place. This isn’t optional. If you don’t have it and your dog causes an incident, you’re uninsured and non-compliant with the law — a double problem.

For dogs classified as potentially dangerous (razas potencialmente peligrosas), the minimum cover required has always been higher: €120,000.

What a proper pet insurance policy actually covers

A comprehensive pet insurance policy in Spain should include:

  • Third-party liability — covering injury or property damage your pet causes to others
  • Legal defence costs — if a claim goes to court, your legal fees are covered
  • Veterinary care — accidents and illness, so you’re not choosing between your pet’s health and your bank account
  • Kennel or cattery fees — if you’re hospitalised and can’t look after your pet, the policy covers boarding costs
  • European travel cover — important if you travel between Spain and your home country with your pet

Is my home contents insurance enough?
